Summary:
Even if the decision of the Federal Constitutional Court of 27 February 2008 on the fundamental right to guarantee the confidentiality and integrity of information technology systems initially concerns online searches and reconnaissance of the Internet in the public sector, this new fundamental right also affects other sectors, according to Prof. Schneider. For the area of technical security, this results in the task of helping the resulting rights to become effective. Prof Schneider pointed out that the recent data scandals, together with the various judgements of the Federal Constitutional Court, have led to a general upgrading of data protection. This could promote the plan to develop IT security law more strongly and to enshrine it in law.
