A title like this should actually start with Smart Law or, even better, Smart Lawyers, because a smart topic also needs smart lawyers. The first opportunity to start the new year with an exciting training programme and to shed light on the further development of the keyword ‘data’ under the aspects of data economy and data control and to be informed about and discuss the new technologies of blockchain & smart contracts.

The main theme of the 2017 symposium is ‘Smart Data, Smart Contracts, Smart Escrow’. Under this event title, the OSE, Organisation pro Software Escrow e.V., in cooperation with DAVIT, is organising the following symposium on Friday, 27 January 2017, from 09:00 at the tried-and-tested location, the Haus der bayerischen Wirtschaft, Max-Joseph-Straße 5, 80333 Munich.

12. OSE SYMPOSIUM

The event will be chaired by lawyer Isabell Conrad (OSE; SSW Schneider Schiffer Weihermüller, Munich), who will also provide the thematic introduction and summarise the morning’s proceedings as an introduction to the second part of the event.

The keyword ‘data’ will then also be taken up in the keynote speech: Rights to data – do we need a new data (banking) law? by Prof. Dr Herbert Zech (Faculty of Law, University of Basel), which will lead into the first block of the event, which will deal with the data economy under the moderation of Dr Philipp Süß (OSE; Reed Smith) and highlight the following aspects:

  • Business to Thing (B2T) interaction, Prof Dr Maximilian Röglinger (University of Bayreuth)
  • Rights to data – statements of the ‘Strategy for the Digital Single Market’ and the fundamental rights to property and freedom of trade, Prof. Dr Andreas Wiebe (University of Göttingen)
  • Platforms – new business models and their implications for politics and legislators, Dr Guido Brinkel (Director Corporate Affairs, Microsoft Berlin)

The 2nd block ‘Data Control’, moderated by Dr Oliver Draf (Data Protection Officer, Allianz Germany), will shed light on this topic in the following presentations:

Google, Facebook & Co. and the new antitrust law, Prof. Dr Torsten Körber, LL.M. (University of Göttingen)
DIN standard Data protection-compliant deletion concept and compatibility with the GDPR, Chris Newiger (Data Protection Officer of Deutsche Bahn AG) (requested)

and then ends with a presentation from the perspective of the supervisory authority

  • The new supervisory authority – new tasks and priorities under the GDPR, Thomas Kranig (President BayLDA, Ansbach)

The 3rd block ‘Blockchain & Smart Contracts’, moderated by attorney Dr Oliver M. Habel (OSE, tecLEGAL Habel Rechtsanwälte), will then address technical and legal aspects of this new approach:

  • Introduction – How does blockchain work? Prof Dr Dr Walter Blocher (University of Kassel)
  • Blockchain – Not only data but also codes / Smart Contract, Dr Markus Kaulartz (CMS Hasche Sigle, Munich)
  • Management of software licences on the blockchain, Prof. Dr Dr Walter Blocher (University of Kassel) & Dr Peter J. Hoppen (OSE; Streitz Hoppen & Partner, Brühl)

The event will conclude with a panel discussion chaired by lawyer Prof Dr Peter Bräutigam (Noerr LLP, Munich).
